The Short Version:

1. You have to criticize their application for something the PUC will consider (see long version). Just opposing it is not good enough - it has to be one of the factors that the PUC has decided it will consider

2. Your testimony has to point out something that is:
        - left out that the PUC requires
        - an incorrect statement

The Long Version:

These chapters will help interested citizens review what the Public Utilities Commission will consider when they hold their Public Hearing on Maui regarding Hawaii SuperFerry, Inc. That meeting will be held on Wednesday, November 17, at 6 PM. Meeting place is Maui Waena Intermediate School Cafeteria, Kahului.

The hearing is specifically being held to consider the application for Certificate of Public Convenience and Necessity (CPCN), which requires PUC approval. The application should be on file at the Maui Office (PUC) at
54 S. High Street, Wailuku, Rm # 218. The requirements for content of the application may be compared with HAR 6-61-74,75. (see below, bottom of this message).

Here are some requirements that must be met in the Superferry application. Comments pointing out lack of completeness or erroneous statements could result in the Certificate being denied.

[§271G-2] Declaration of policy. The legislature of this State recognizes and declares that the transportation of persons and of property, for commercial purposes, by water within the State or between points within the State, constitutes a business affected with the public interest. It is intended by this chapter to provide for fair and impartial regulation of such transportation, so administered as to recognize and preserve the inherent advantages of such transportation, in the interest of preserving for the public the full benefit and use of the waterways consistent with the public safety and the needs of commerce: to promote safe, adequate, economical, and efficient service among carriers, to encourage the establishment and maintenance of reasonable rates and charges for transportation
and related accessorial service, without unjust discrimination, undue preference or advantage, or unfair or destructive competitive practices, all to the end of developing, coordinating, and preserving a sound transportation system by water. This chapter shall be administered and enforced with a view to carrying out the above declaration of policy. [L 1974, c 94, pt of §1]

(c) A certificate shall be issued to any qualified applicant therefor, authorizing the whole or any part of the operations covered by the application if it is found that the applicant is fit, willing, and able properly to perform the service proposed and to conform to this chapter and the requirements, rules, and regulations of the commission thereunder, and that the proposed service, to the extent to be authorized by the certificate, is or will be required by the present or future public convenience and necessity; otherwise the application shall be denied.

(1) A general description of the type of service being performed or proposed by
the applicant, a reference to the statutory authority under which existing service is or
will be performed, and a statement of the specific authority requested;

(2) The geographical scope of the proposed operation, including the termini and
other points proposed to be served, and a concise narrative description of the
proposed service;

(3) A statement of the rates or fares proposed to be charged, rules governing
service, and the level and nature of proposed rates. Reference may be made to a
tariff or tariffs on file with the commission;

(4) The frequency of the proposed service and the number of parties to be served;

(5) The kind and approximate number of units of equipment to be employed in the
proposed service;

(6) The qualification and experience of key personnel;

(7) A statement of financial ability to render the proposed service together with a
financial statement in accordance with section 6-61-75; and

(8) Facts showing that the proposed service will be required by the present and
future convenience and necessity and is in compliance with the policy declared in section
271G-2, HRS.
