Did Mr Garibaldi Lie Under Oath?
It is alleged that HSF funded the Dolphin Institute, Adam Pack PhD principle investigator, to do an impact study last year off Maui. operating a land station from Kapalua airport. They ran their research boat (25' long) through the area between Kapalua and Moloka'i at 25 knots. the land station attempted to guide them thru the area to avoid whales. they could not, and the mini-hsf frequently found itself on a collision course.
These findings verify the PWFfinds of surprise encounters every 9 miles in Maui waters.
This data was collected and known to HSF prior to the trial (collected in Jan - April 07) yet Mr. Garibaldi feigned ignorance of any such studies or data.
Further this study, having been conducted over the past couple years (with regard to boat whales), will show the density of whales in this area and further prove the need for HSF to avoid taking the 'southern' route.
